Pomarium LLC (“Pomarium”, “we”, “us”) provides orchard analytics software: the website at pomarium.ag, the GAIA service for orchard customers, and the Pomarium AGER app for iPhone, iPad, Android and the web. This policy explains what information we collect when you use them, how we use it, who we share it with and the choices you have. By using our services you agree to the practices described here.
1. Information we collect
Information you give us
- Account details. For an AGER account: your email address and a password, which we store only as a secure hash. For a GAIA account: the login name, company name and contact email that an administrator set up for you. We never store a password in readable form.
- Content you create. The field outlines you draw or that were drawn for your orchard, the names you give them and, for GAIA customers, the block details and yield records you enter.
- Messages. What you write to us when you ask for support.
Purchase information
- AGER Saved subscriptions are bought inside the Apple App Store or Google Play, which act as the merchant of record. We receive a purchase or transaction identifier and the date your access runs to, and we re-check that status with the store periodically. We never receive your card number, billing address or payment details.
Information collected automatically
- Server logs. Ordinary web server records: IP address, browser or app type, the pages and requests made, and their times. We use them to keep the service secure and available, to troubleshoot problems and to enforce usage limits on public pages. They are kept for a short period and then discarded.
- Public tools without an account. If you use “Try your block” or AGER without signing in, nothing about you is stored. A short-lived cache of the computed result, keyed by the outline and not by any identifier of yours, lets a repeated request answer without recomputing.
Location
- With your permission, the AGER app uses your device’s location to centre the map on the field you are standing in. Your position is used on the device and is not sent to or stored by us. Only the field outline you draw is sent to our servers for computation. You can use the app without granting location access by panning the map or searching for a place.
2. What we do not collect
We use no advertising identifiers, no advertising or analytics SDKs, and no third-party trackers. We do not track you across other companies’ apps or websites, we do not build profiles for advertising, and we do not sell, rent or trade your information to anyone. Information is not used for “tracking” as Apple and Google define it in their app privacy disclosures.
3. How we use information
- To provide the service you asked for: computing satellite, weather and crop readings for the outlines you draw, and keeping your saved fields between visits.
- To create and secure your account, sign you in and remember your session.
- To verify and renew subscriptions with the App Store or Google Play and to grant the features you paid for.
- To send service email: account confirmation, password resets, receipts of actions you took, and reports you asked for. We do not send marketing email without your consent.
- To answer your questions and provide support.
- To keep the service secure, prevent abuse and enforce usage limits.
- To comply with legal obligations, including tax and accounting rules.
Where the law of your country requires a legal basis (for example in the EEA or the UK), we rely on the performance of our contract with you, our legitimate interest in running a secure and reliable service, our legal obligations, and your consent where it is required.
4. Service providers
We use a small number of providers to run the service. Each receives only what it needs for its task and may not use it for anything else.
- Heroku (Salesforce) — hosting and database, in the United States.
- Google Earth Engine — satellite imagery processing. Field outlines are sent for computation; the results are returned to you.
- Esri — the satellite basemap. Map tile requests carry the area you are viewing and your IP address, as with any online map.
- OpenStreetMap (Nominatim) — the place search box. The text you type is sent to find a location.
- Open-Meteo — weather data for a field’s coordinates.
- Apple App Store and Google Play — purchases, billing and subscription management for the AGER app, under their own privacy policies.
- Postmark and Google — delivery of service email.
- Anthropic — the plain-language readings shown beside some GAIA figures. The numbers being described are sent; your identity is not.
5. When we share information
We share information only with the providers above, when required by law or a valid legal request, when necessary to protect the rights, safety or property of Pomarium, our users or others, or as part of a merger or sale of the business, in which case you will be notified. We do not sell personal information.
6. How long we keep it
- Account details and saved fields: for as long as your account is open. When you delete your account they are removed at once from the live database and from backups in the ordinary backup cycle, within 30 days.
- Purchase records: as long as tax and accounting rules require.
- Server logs: a short period, typically days to a few weeks.
7. Security
All traffic between your device and our servers is encrypted. Passwords are stored as salted hashes. Access to production systems is limited to the people who operate the service. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your information appropriately.
8. Your rights and choices
Depending on where you live, you may have the right to access the personal information we hold about you, to correct it, to receive a copy in a portable form, to have it deleted, to object to or restrict certain processing, and to withdraw consent where processing is based on consent. We do not sell personal information, so there is nothing to opt out of on that front, and we will not treat you differently for exercising your rights.
To exercise any of these rights write to hello@pomarium.ag. We respond within 30 days. If you are in the EEA, the UK or another region with a data protection authority, you may also complain to that authority.
9. Deleting your account
AGER accounts can be deleted at any time from the app (menu → Account → “Delete my account”) or directly at pomarium.ag/ager/delete-account. Deletion removes the account and every saved field. An active subscription is managed by the store you bought it from; deleting your account does not cancel it, so cancel it in your App Store or Google Play subscription settings as well. GAIA customers should ask their administrator or write to us.
10. Children
Our services are for working growers and are not directed at children under 16. We do not knowingly collect personal information from children. If you believe a child has given us information, write to us and we will delete it.
11. International transfers
Our servers are in the United States. If you use the service from elsewhere, your information is transferred to and processed there. Where required, we rely on recognised safeguards such as standard contractual clauses for those transfers.
12. Changes to this policy
We may update this policy as the service changes. The date at the top shows when it was last revised. If a change is material we will tell you by email or a notice in the app or on the website before it takes effect.
